Legal basis

Below you will find an overview of the legal basis of the GDPR on which we base the processing of personal data. Please note that in addition to the provisions of the GDPR, national data protection provisions of your or our country of residence or domicile may also apply. If, in addition, more specific legal bases are relevant in individual cases, we will inform you of these in the data protection declaration.

Consent (according to Art. 6 para. 1 lit. a GDPR): The data subject has given his/her consent to the processing of personal data relating to him/her for a specific purpose or purposes.

Contract fulfillment and pre-contractual requests (according to Art. 6 para. 1 lit. b GDPR): Processing is necessary for the performance of a contract to which the data subject is party or for the performance of pre-contractual measures taken at the data subject’s request.

Legal obligation (according to Art. 6 para. 1 lit. c GDPR): Processing is necessary for compliance with a legal obligation to which the controller is subject.

Legitimate interests (according to Art. 6 para. 1 lit. f GDPR): Processing is necessary to protect the legitimate interests of the controller or a third party, unless such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require the protection of personal data.

In addition to the data protection regulations of the General Data Protection Regulation (GDPR), national regulations on data protection apply in Austria. These include, in particular, the Federal Act on the Protection of Individuals with regard to the Processing of Personal Data (Data Protection Act “DSG”). In particular, the DSG contains specific regulations on the right to information, the right to rectification or deletion of personal data and the right to restriction of processing.

Security measures

In accordance with legal requirements and taking into account the state of the art, implementation costs and the nature of the scope, circumstances and purpose of the processing, as well as different probabilities of occurrence and the extent of the threat to the rights and freedoms of natural persons, we take appropriate technical and organizational measures to ensure a level of protection appropriate to the risk.

In particular, the measures include safeguarding the confidentiality, integrity and availability of data by controlling physical and electronic access to this data, as well as its access, entry, disclosure, safeguarding of availability and separation. Furthermore, we have established procedures to ensure the exercise of data subjects’ rights, deletion of data, and responses to data compromise. In addition, we take the protection of personal data into account as early as the development and selection of hardware, software and processes through technology design and data protection-friendly default settings.

SSL or TLS encryption: This website uses SSL or TLS encryption for security reasons and to protect the transmission of confidential content, such as requests that you send to us as the website operator. You can recognize an encrypted connection by the fact that the address line of the browser changes from “http://” to “https://” and by the lock symbol in the browser line. If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

Transmission of personal data

In the course of our processing of personal data, it may happen that the data is transferred to or disclosed to other bodies, companies, legally independent organizational units or persons. The recipients of this data may include, for example, service providers commissioned with IT tasks or providers of services and content that are integrated into the website. In doing so, we observe the legal requirements and, in particular, conclude corresponding contracts or agreements that serve to protect your data with the recipients of your data.

Data processing in third countries

If we process data in a third country, i.e. outside the European Union (EU), or the European Economic Area (EEA), or if the processing takes place in the context of the use of third-party services, or if a disclosure or transfer of data to other persons, bodies or companies takes place, this is done in accordance with the legal requirements.

Subject to explicit consent, transfer required by contract or by law, data will only be processed in third countries with a recognized level of data protection or where appropriate safeguards are in place, including binding internal data protection rules as well as other conditions (GDPR, Art. 44 to 49).

Deletion of data

The data processed by us will be deleted in accordance with the legal requirements as soon as the consents granted for processing are revoked or other permissions cease to apply (e.g. if the purpose for processing this data is no longer given).

In the event that the data is not deleted because it is required for other and legally permissible purposes, its processing will be limited to these purposes. Such data will be blocked and not processed for other purposes. Such cases may concern data that must be retained for reasons of tax law or is necessary for the assertion, exercise and defense of legal claims or for the protection of rights of natural or legal persons.

Our privacy notices may also contain further information on the retention and deletion of data that is specific to the processing operations in question.

Changes and updates to the privacy policy

We change or update the data protection declaration if changes in the data processing carried out by us make this necessary. Therefore, we ask you to regularly inform yourself about the content of our privacy policy. If such changes require your cooperation (such as renewed consent) or other individual notification, we will inform you accordingly.

Rights of the data subjects

As a data subject, you are entitled to various rights under the GDPR, which arise in particular from the GDPR, Art. 15 to 21:

Right of access: You have the right to request confirmation as to whether data concerning you is being processed and the right to obtain information about this personal data, as well as further information and a copy of the personal data.

Right to rectification: You have the right to obtain without undue delay the rectification of inaccurate data concerning you and, having regard to the purposes of the processing, the completion of incomplete personal data.

Right to erasure: You have the right to request that personal data concerning you be deleted without delay, provided that the reasons stated in the legal requirements apply.

Right to restriction of processing: You have the right to request the restriction of the processing of personal data, provided that the conditions specified in the legal requirements are met.

Right to data portability: You have the right to receive personal data concerning you that you have provided to us in a structured, common and machine-readable format and you have the right to transfer this data to another controller, provided that the conditions specified in the legal requirements are met.

Right to object: You have the right to object at any time, on reasons relating to your particular situation, to the processing of personal data concerning you which is carried out on the basis of Art. 6 para. 1 lit. e or f GDPR; this also applies to profiling based on these provisions. If personal data concerning you is processed for the purposes of direct marketing, you as the data subject have the right to object at any time to processing of personal data concerning you for such marketing; this also applies to profiling insofar as it is related to such direct marketing.

Right to revoke consent: You have the right to revoke your consent at any time.

Right of appeal to a supervisory authority: Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority which is responsible in accordance with the law, in particular a supervisory authority on the territory of its own Member State or of the Member State concerned by any breach, if you consider that the processing of personal data relating to you infringes the requirements of the GDPR.

Cookies

This website uses so-called cookies. Cookies do not harm your device and do not contain viruses. Cookies are small text files that are stored on your end device with the help of your browser. Cookies primarily serve to make our online offer more user-friendly, effective and secure.

Most of the cookies we use are temporary cookies (session cookies). They are automatically deleted after the end of your visit. Permanent cookies remain stored on your terminal device until you delete them. These cookies enable us to recognize your browser on your next visit. Unless we provide explicit information about the storage period of permanent cookies (e.g. in the context of a cookie consent), assume that the storage period can be up to two years.

Such profiles are used, for example, to show users content that matches their potential interests. This process is also referred to as “tracking” and means that the potential interests of users are tracked. Notes on legal bases: The type of legal basis on which we process your personal data using cookies depends on whether we ask for your consent. If you consent to the use of cookies, the legal basis for the processing of your data is your declared consent. Otherwise, the data processed with the help of cookies is processed on the basis of our legitimate interests (e.g. in the business operation of our online offer and its improvement) or, if the use of cookies is necessary to fulfill our contractual obligations.

Notes on consent (opt-in): We use cookies in accordance with the law. Therefore, we obtain prior consent from you as a user, except where this is not required by law. In this case, the declaration of consent is stored in order not to have to repeat its request and to be able to prove the consent in accordance with the legal obligation. The duration of the storage of the consent can be up to two years.

General notes on revocation and objection (opt-out): Depending on whether the processing is based on consent or legal permission, you have the option at any time to revoke the consent you have given or to object to the processing of your data by cookie technologies. You can initially declare your objection via your browser settings, e.g. by deactivating the use of cookies (which may limit the functionality of our website). Processing of cookie data on the basis of consent

On our website, we use a cookie consent management process, with which the consent of users to the use of cookies and the processing and providers mentioned in its context can be obtained, managed and revoked. The declaration of consent is stored so that it does not have to be repeated and so that the consent can be proven in accordance with the legal obligation. The consent can be stored on the server side, in a cookie (so-called opt-in cookie) or with the help of comparable technologies in order to be able to assign the consent to a user or their device.

The duration of the storage of consent can be up to two years. A pseudonymous user identifier is created and stored with the time of consent, information on the scope of consent (e.g. cookie categories, service providers), as well as the browser, operating system and end device used.

Provision of the online offer and webhosting

In order to provide our online offer securely and efficiently, we use the services of one or more web hosting providers from whose servers (or servers managed by them) our online offer can be accessed. For these purposes, we may use infrastructure and platform services, computing capacity, storage space and database services as well as security services and technical maintenance services.

The data processed as part of the provision of the hosting service may include all related information of the users of our online service, which is generated as part of the use and communication. This includes the IP address, which is necessary to deliver the content of online offers to browsers, and all entries made within our online offer or from websites.

E-mail dispatch and hosting

The web hosting services we use also include the dispatch, receipt and storage of e-mails. For these purposes, the addresses of the recipients and senders as well as further information regarding the e-mail dispatch (e.g. the providers involved) and the contents of the respective e-mails are processed. The aforementioned data may also be processed for SPAM detection purposes.

Please note that e-mails are generally not sent encrypted on the Internet. As a rule, e-mails are encrypted in transit, but (unless a so-called end-to-end encryption method is used) not on the servers from which they are sent and received. We can therefore not assume any responsibility for the transmission path of the e-mails between the sender and the reception on our server.

Access Data and Server Log Files

When visiting our website, the website operator or the web hosting provider collect data about accesses to the server based on legitimate interest (according to Art. 6 para. 1 lit. f GDPR) and automatically store them as “server log files” on the website server. This data may include the address and name of the web pages and files accessed, the date and time at the time of access, the amount of data transferred, the browser type and version, the user’s operating system, the source/reference of the previously visited page (referrer URL), the IP address used and the requesting provider.

Server log files can be used for security purposes on the one hand, e.g., to prevent server overload (especially in the case of abusive attacks, so-called DDoS attacks), and on the other hand, to ensure server utilization and stability.

Server log file information is stored for a maximum of 30 days and then deleted or anonymized. If we become aware of specific indications of illegal behavior, we reserve the right to retain this data until the final clarification of the respective incident.

Content delivery network

To improve security and increase delivery speed, we use a content delivery network (CDN) on our website due to legitimate interests (according to Art. 6 para. 1 lit. f GDPR). A CDN is a service with which the content of an online offering (e.g. media files or program scripts) can be delivered more securely and quickly with the help of regionally distributed servers connected via the Internet.

Personal data

It is possible to visit this website without providing any personal information. Should you provide us with your personal data, such as name, e-mail address and telephone number, we will only use them if this is permitted by law or if you consent to the collection of data. The processing of personal data is based on our legitimate interest in fulfilling our contractually agreed services and optimizing our online offering. We will not pass this data on to third parties without your consent.

Contact form

If you send us inquiries via a contact form on the website, the data you send us will be stored by us on the basis of legitimate interests for processing the inquiry and in case of follow-up questions. This data will not be passed on to third parties without your consent.

Comment function

For the comment function on this website, in addition to your comment, information on the time of the creation of the comment, your e-mail address and the username you have chosen will be stored. Based on our legitimate interests, our comment function stores the IP addresses of users who post comments. Since we do not check comments on our site before they are activated, we need this data in order to be able to take action against the author in the event of legal violations such as insults or propaganda. In addition, we reserve the right, based on our legitimate interests, to process users’ details for the purpose of detecting spam. The comments and the associated data (e.g. IP address) are stored and remain on our website until the commented content has been completely deleted or the comments have to be deleted for legal reasons (e.g. offensive comments).

Newsletter

If you would like to receive the newsletter offered on the website, we require an e-mail address from you as well as information that allows us to verify that you are the owner of the specified e-mail address and agree to receive the newsletter. Further data will not be collected. We use this data exclusively for sending the newsletter and do not pass it on to third parties.

The processing of your data entered in the registration form of our newsletter is based exclusively on your consent (according to Art. 6 para. 1 lit. a GDPR). You can revoke your consent to the storage of the data, the e-mail address and their use for sending the newsletter at any time, for example via the “unsubscribe” link that we integrate in every newsletter.

Online marketing and affiliate programs

As the operator of the website, we participate in affiliate programs (partner programs) of third-party providers and thereby integrate advertisements or so-called affiliate links into our online offer. If users follow these links, we may receive a commission when they take advantage of their offers.

No cookies are used on our website for this purpose. When a user clicks on an affiliate link or an advertisement, the respective third-party provider may set cookies to track that the user followed the link starting from our website. Presences in social networks (social media)

We maintain online presences within social networks and process user data in order to communicate with users active there or to offer information about our services. We would like to point out that user data may be processed outside the European Union, which may result in risks for users, e.g. because it may be more difficult to enforce your rights. Plugins, embedded functions and content

Polylang

To enable multilingualism on our website, we use the Polylang plugin. Cookies from Polylang are set exclusively to recognize and record the language used or selected by the user and only store your choice of language. There is no transfer of your data to the producer of the plugin. These cookies remain stored for one year and are then deleted.

When you visit a page on our website that is equipped with a function of WeatherWidget.io, a connection to the servers of WeatherWidget.io is established. In the process, data is sent to WeatherWidget.io. This data may include information such as the IP address of your computer, browser type, browser version, the pages of our service that you visit, the time and date of your visit, the time spent on these pages and other statistics.

According to WeatherWidget.io’s own statements, WeatherWidget.io does not collect, store, or share data related to a specific user or device (including IP addresses and user IDs) on websites or apps that are not owned by WeatherWidget.io. Nevertheless, we point out that we, as the provider of the pages, do not obtain knowledge of the content of the transmitted data as well as its use by WeatherWidget.io.

Google Fonts and Google Web Fonts

This website uses Google Fonts for the user-friendly presentation of our online offer, which represents a legitimate interest (according to Art. 6 para. 1 lit. f GDPR). These Google Fonts are hosted on our server, which means that no data is transmitted to Google.

In addition, we use Google Web Fonts on certain pages of our website for the secure, maintenance-free and efficient display of fonts of third-party content and features, such as Google Maps. When you access these pages, your browser loads the required Google Web Fonts into your browser cache in order to display texts and fonts correctly. For this purpose, the browser you use must connect to Google’s servers. This gives Google knowledge that our website has been accessed via your IP address. This information may be processed on a Google server in the USA. Google Analytics

This website uses functions of the web analytics service Google Analytics for reach measurement and web analytics to perform user analysis based on a pseudonymous user identification number. This identification number does not contain any unique data, such as names or e-mail addresses. It is used to assign analysis information to an end device in order to identify which content users have accessed within various usage processes, which search terms they have used or interacted with our online offering. Likewise, the time of use and its duration are stored, as are the sources of the users referring to our website and technical aspects of their end devices and browsers. This involves creating pseudonymous profiles of users with information from the use of various devices, using “cookies”. These are text files that are stored on your computer and enable an analysis of your use of the website. In Google Analytics, geographic location data is provided at a higher level by collecting geographic metadata (such as “city” or “continent”) based on the IP address.

To ensure the protection of user data in the European Union (EU), Google receives and processes all user data via domains and servers within the EU. The IP addresses of users are not logged here and are shortened by the last two digits on EU servers for EU users by default. All sensitive data collected from users in the EU is deleted before it is collected via EU domain servers.
